Terms of Service

By accessing or using the CredGuard platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the platform. These terms apply to all users, including agency owners, administrators, and viewers.

CredGuard is a credential management platform designed for nursing agencies. The platform enables agencies to track nurse credentials, receive expiration reminders, verify licenses through Nursys, and maintain compliance records.

Important: Credential verification results provided through CredGuard are informational only and do not constitute legal advice, regulatory compliance certification, or a guarantee of license validity. Agencies remain responsible for independently verifying credentials and maintaining compliance with applicable regulations.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must:

• Provide accurate and complete registration information
• Notify us immediately of any unauthorized use of your account
• Ensure that team members you invite use the platform in accordance with these terms

Agency owners are responsible for managing roles and permissions within their organization and for the actions of all users they invite.

You agree not to:

• Use the platform for any unlawful purpose or in violation of healthcare regulations
• Upload false, misleading, or fraudulent credential information
• Attempt to gain unauthorized access to other agencies' data
• Interfere with or disrupt the platform or its infrastructure
• Reverse-engineer, decompile, or attempt to extract the source code of the platform
• Use automated tools to scrape or extract data from the platform without authorization

The CredGuard platform, including its design, features, and content, is owned by CredGuard and protected by intellectual property laws. You retain ownership of the data you upload to the platform. By using the platform, you grant us a limited license to process your data solely for the purpose of providing the service.

Paid features are billed through Stripe. By subscribing to a paid plan, you agree to pay the applicable fees. Subscription fees are non-refundable except where required by law. We reserve the right to change pricing with 30 days' notice.

To the maximum extent permitted by law, CredGuard shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. This includes, but is not limited to, damages resulting from:

• Reliance on credential verification results without independent verification
• Interruptions to the platform or notification delivery
• Unauthorized access to your account due to compromised credentials
• Regulatory penalties resulting from compliance decisions made using the platform

Our total liability shall not exceed the amount you paid for the service in the twelve months preceding the claim.

You may close your account at any time by contacting us. We may suspend or terminate your access if you violate these terms or engage in activity that harms the platform or other users. Upon termination, your right to use the platform ceases immediately. We will retain your data for 30 days following termination, after which it will be deleted unless retention is required by law.

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these terms or your use of the platform shall be resolved in the courts of Delaware.

We may update these terms from time to time. When we make material changes, we will notify you by email or through a notice on the platform. Your continued use of the platform after changes take effect constitutes acceptance of the revised terms.
